HVAC permit requirements in Arizona

Arizona has no statewide residential building code. A.R.S. 34-461 codifies a local-code framework: each city, town, and county adopts and enforces its own codes, so the permit rules for your AC changeout depend entirely on which jurisdiction the house sits in. Typical local practice is that a residential AC or heat pump changeout requires a mechanical permit pulled by the licensed contractor (Arizona ROC license) — not by you.

Phoenix is the notable exception, and it documents the rules precisely. Under TRT/DOC/00687 (citing IBC 105.1/105.2), a strict like-for-like replacement can be approved as permit-exempt. But the exemption is narrow — a permit IS required if any of these apply:

• The unit moves to a different location
• The footprint or weight changes (a rooftop concern in Phoenix)
• Ductwork or building penetrations are modified
• Electrical amp draw or gas demand increases
• The unit holds 10 or more pounds of refrigerant (roughly systems over 5 tons)
• Indoor components are replaced, not just the outdoor unit

In practice, a true exempt swap means the same size unit in the same spot with no other changes. Upsizing, relocating, or touching ducts puts you back in permit territory.
