HVAC permit requirements in Georgia

Every residential HVAC changeout in Georgia has to meet the same code — and that is rarer than you would think. Under the Uniform Codes Act, O.C.G.A. 8-2-20(9)(B) designates the International Mechanical Code a mandatory minimum standard code statewide. The current edition is the 2024 IMC with Georgia Amendments, effective January 1, 2026. Per the Georgia Department of Community Affairs, mandatory codes apply to all construction whether or not the local government enforces them: a rural county with no building department does not exempt you from the code, it just means nobody is inspecting.

Administration is local. O.C.G.A. 8-2-25 leaves permitting and inspection to cities and counties, and in practice every metro-Atlanta jurisdiction requires a mechanical permit for a residential HVAC changeout. Fees vary because there is no state fee schedule. The one formula verified from an official county document: Gwinnett County charges $0.006 times construction value with a $30 minimum for a mechanical-only residential permit, which puts a typical $5,000-$15,000 changeout at roughly $30-$90. Other metro jurisdictions use their own flat or value-based schedules — call yours before assuming.

Who pulls the permit? Normally the installer, who must be a Georgia-licensed Conditioned Air Contractor. Some jurisdictions allow homeowners to pull permits for their own primary residence under local rules, but that is jurisdiction-by-jurisdiction, not a state right.
